Having been reviewed and approved by the Ministry of Industry and Information, and as well as agreed by the Development and Reform Commission, the Ministry of Science and Technology, the Ministry of Finance, the Ministry of Environmental Protection, the Ministry of Commerce, the General Administration of Customs and General Administration of Quality Supervision, Inspection and Quarantine(AQSIQ), the Administrative Measures for the Restriction of the Use of Hazardous Substances Electrical and Electronic Products is hereby released, and comes into effect from the date of July 1st, 2016. At the same time, the Measures for the Control of Pollution in Electronic Information Products (original Ministry of Information Industry, Development and Reform Commission, Ministry of Commerce, General Administration of Customs,Administration of Industry and Commerce, AQSIQ and the Ministry of Environmental Protection Order No.39) which was released on the date of 28 Feb 2006 shall be abolished.
Article 1 In order to control and reduce the pollution to the environment caused by the waste electrical and electronic products, to promote cleaner production in electrical and electronic industry and integrated use of resources, to encourage green consumption, to protect the environment and human health, the measures are enacted in accordance with the laws and administrative regulations such as Cleaner Production Promotion Law of the People's Republic of China, Law of the People's Republic of China on the Prevention and Control of Environmental Pollution Solid Waste, Waste Electrical and Electronic Products Recovery Management Ordinance.
Article 2 The regulations are applicable to the electrical and electronic products which are produced, sold and imported within the territory of the People's Republic of China.
Article 3 The meaning of the following terms in the measures are:
(Ⅰ) Electrical and electronic product means a device and its accessory product with rated working electrical voltages of no more than 1500 volts direct current and 1000 volts alternating current which function by means of current or electromagnetic fields, and generate, transmit and measure such currents and electromagnetic fields. The equipments involving the generation, transmission and distribution of power are excluded.
(Ⅱ) Pollution of electrical and electronic products means the hazardous substances contained in the electrical and electronic products exceeds the national standard or industry standard, as a result it causes destruction, damage, waste and other adverse effects to the environment, resources, human health, life, and property safety.
